• Personal Recognizance Bond: This allows the defendant to be released without posting any money, based on their promise to appear in court. These are less common in federal cases and are typically granted to defendants considered low-risk.
• Cash Bond: The defendant or a third party pays the full bond amount in cash. This amount is held as a guarantee that the defendant will appear in court. Upon fulfilling all court appearances, the money is usually refunded, minus any court costs, penalties, and judgments.
• Corporate Surety Bond: This involves a licensed bail bond agent or company that guarantees the bond amount to the court. The defendant or their family pays a 15% non-refundable premium of the total bond amount and the bond agent assumes responsibility if the defendant fails to appear.

Who Is Eligible for a Federal Bond?

Eligibility for a federal bond is determined by the federal magistrate during the initial hearing. Factors considered include:

• The severity of the crime.
• The defendant’s criminal history.
• The likelihood of the defendant fleeing.
• The defendant’s ties to the community.

Not all defendants are eligible for bail, especially if they are deemed a flight risk or a danger to the community.

How Much Does a Federal Bond Cost?

The cost of a federal bond is typically higher than state bonds due to the severity and complexity of federal cases. The bond amount is set by the federal magistrate and can vary widely. Bail bond companies usually charge a non-refundable fee, which is a percentage of the total bond amount. Additionally, collateral may be required to secure the bond.

What Are the Conditions of a Federal Bond?

When a federal bond is posted, the defendant must comply with certain conditions, such as:

• Appearing for all court hearings.
• Reporting regularly to a pretrial services officer.
• Abiding by travel restrictions.
• Refraining from illegal activities or associating with known criminals.
• Complying with any other specific requirements set by the court.

Failure to comply with these conditions can result in the revocation of bail and the defendant being returned to custody.
